
Unfair DismissalThe negative effect the recession is having on employers may well be the reason for unfair dismissal becoming the most frequently cited complaint under employment law with the number of claims rising dramatically over the last year. If you consider that you have been unfairly dismissed, you should first try to resolve the situation with your employer. This will not only create the possibility of you being reinstated but it will be looked upon favourably should your claim proceed to a hearing. Make sure you keep a record of all correspondence such as letters, telephone calls and meetings and keep all communication polite, civil and honest. If you would prefer to avoid formal proceedings, the Advisory, Conciliation and Arbitration Service (ACAS) can act as a mediator to try and resolve the problem informally. However, if this is not feasible or is unsuccessful you can take your employer to an employment tribunal. An employment tribunal is similar to a court, but is less formal, and only deals with employment cases. A solicitor will help with the formalities involved such as application to the tribunal and any deadlines. They may also be able to offer further advice on resolving the matter directly before taking action at a tribunal. |
